Please let me know if a charitable trust have to pay service tax under the Service Tax Act?
Q. for "Commercial Training and coaching" in India. What are the circumstances under which service tax is not payable by an educational institution.

A. Imposition of service tax has nothing to do with the banner from which service is rendered. Finance Act has not given any exemption to charitable or similar other organinsation for rendering "Commercial Training and Coaching Services". However following services are exempt and not liable to tax by any type of banner. 1-Sports Training 2- Pre School Training Centre 3- Degree or Diploma by any institutions. 4- Tutions services by any individual at own house 5- Hobby Classes 6- Vocational Classes 7- Recreational Training

Why do I have to pay Estate Tax on Charitable Reminder Trust?
Q. My husband died in Dec 2008 and we are filing his 706. Why does the estate pay and then we pay again when the CRT pays income? His charitable reminder trust was 20 years or his life. There are 4 more years, 2012. thanks

A. The estate paid the tax on the money that was already in the trust when he died. You pay tax on the money that was earned later. It is not the same money. Similarly, if I earn money at a job, pay tax on it, and then earn more money at another job, I pay tax on that money, too, even though I have already paid tax on other money.

A. Yes it can be done with amending Trust Deed and giving referance of orignal deed and need of changes.If Trust is registered trust then amended deed also to be registered with Registrar.

A. Often you can get an annuity in return for your generous contribution. In the USA, you can get an immediate tax deduction for the donation then receive partially tax-free income for life. Here is a site that is promoting such donations in my area: I'd consider it if I were in one of two situations. First is not having any family to give it to. Second is having excess wealth... for I believe in Warren Buffet's comment, "I want to give my kids enough so that they could feel that they could do anything, but not so much that they could do nothing."

A. You have to start with a board of directors -- a group of people dedicated to the idea of this charitable trust and who are willing to donate the money needed to get you started. Is your trust going to provide services, or, is it going to provide funding for NGOs to provide services? A. A corporation is a legal person and may do any act not specifically prohibited by law. A corporation may donate the same as any other person with some specific exceptions related to elections in some states. You say "I'd like to donate...". If you use the corporation to act as you individually you are creating proof that it is a sham corporation and a creditor can attack the corporate veil. Make sure that you have properly documented resolutions to support the donation.

A. I don't know about india specifically, but generally the answer is yes, so long as you don't make profit. The problem is, it's sometimes difficult not to have a profit at the end of a financial year, even if it's going to be spent on charity later. To solve this, many charities have a separate company that's technically for profit.
