Has anyone that filed injured spouse received their stimulus direct deposit yet?
Q. I filed back in February, it takes 11 extra weeks to process injured spouse, I received my 2007 refund a month ago, and the last two of my husbands is 03.

A. When I called the IRS, they stated that if you selected Direct Deposit orginally on the 1040 then your stimulus should still get direct deposited. Crossing fingers...

Has anyone filed injured spouse?
Q. My huband and I filed together. We filed efile using Turbo Tax. I owe on old school loans, so we filed injured spouse this year. I got the email that it was accepted by the IRS. Will I be getting that anount or will they still be taking money out? Either way, will we be getting it back in around two weeks or will we have a longer wait because we filed injured spouse?

A. The IRS will withhold your part of the tax refund to continue paying on the delinquent school loan until it is paid off. Your husband will receive his part of the refund. It may take longer, since it requires special processing. No way to tell except to call the IRS and ask.

A. Do you mean arrears on your child support? The Injured Spouse form seperates your income from your husbands on a joint return and then seperates the taxes due, as well as the credits, and refundable credits so that if you are due a refund, you'll get your portion. Its important to list all the "child" credits to the injured spouse since the purpose of these is to free up income for household with children and not to pay off your husbands debts. Need Help?

how long do i get my taxes after filing injured spouse?

A. Yes, it will take longer even when you file it with the return, since a human has to look it over and do the allocation between the debtor and the injured spouse. Anytime a human is involved, it takes longer. I usually tell my client don't worry until it has been six weeks but most tell me the see it in four.

We filed taxes this year and no injured spouse form How can we find out what he owes for child support?
Q. My husband and I usually file injured spouse for but this year we decided that we weren't to pay off the child support, however, I would like to check to see how much he still owes. We have not recieved anything from the state yet about this. We efiled through h&r block and should have our money back within a couple weeks but I still want to make sure it goes with what I have on record for what is owed. After all it is my money. My husband is disabled.

A. If you pay through the state if you go to your state office they would be able to tell you what he ows for child support under those conditions.

Q. I know they said they are working on those after they get all of the regular rebates sent out, atleast that is what one IRS rep told me. I was just wondering if anyone has received theirs yet. And yes, I have checked the status online.

A. NO!!! We filed form 8379 with our tax return in March, and received our refund in May. We received a letter May 23 stating our stimulus check was offsett. I called the IRS and they said to file another injured spouse claim and write stimulus rebate on top. We sent that right in and as of today still no rebate check. I called the IRS again just to see if they had any info (Big waste of time), and they told me it would be at least 45 - 60 days. good luck!!!

Q. I filed the injured spouse form as husband owes back child support. The lady at Jackson Hewitt gave me my amounts for our state and fed refunds. Got state back and DCSE took 1/2 of it. Are they going to take 1/2 of my fed return too? If so i am pissed, Jackson Hewitt preparer did not tell me they would take 1/2 of it. I thought i was to get the whole refund. Or either i misunderstood. I live in VA.

A. You get 100 percent of YOUR share of the total refund, based on YOUR income. The part of your joint refund that is based on your husband's income will get taken.

A. Hi. Even if you file injured spouse the extra rebate checks often go to whom the spouse owes . It happened to me. Why? Because the injured spouse form is used in the original filing, but isn't in the faces where they see it with the rebate. If this happens, you probably would never see it as I didn't because the IRS tells you that you will have to contact the people it went to and tell them it is your money and you want it back. They will give you a whole lot of run around and you would end up having to sue for it. If they are local you have a better chance than if they are out of state. I now file separate but married to avoid further problems.

A. Your husband can file MFS (with your SSN on the form) and even claim your $3400 exemption because you have $0 income. This can be efiled and there would be no delays in getting the refund. However, it could be a smaller refund. (If you have no children and no credits, this is all he'd get under injured spouse *anyway*.) You and your husband can file MFJ and add the form 8379. You can still efile. AFTER the efiled return is processed, the IRS will hold it until the injured spouse form can be processed. This will take an additional 6-8 weeks. You can even amend an MFS return into an MFJ return within 3 years. Do not forget that your husband is the injured spouse. Any reference to innocent spouse is invalid.

A. They didn't take half of YOUR payment - there isn't a YOUR payment. There is a joint payment to the two of you totalling $900. They took half of it, and because of the injured spouse payment, sent you the other half, $450.

A. He can't cash the check until you sign it. And if I were you I would bring it to court and tell them he's behind on back due child support so the whole thing needs to go to you. But the stimulus is unearned money so no they shouldn't orginally try take the back due child support from it.

A. Sorry, no Why are there arrears? If there is a legitimate reason, such as unemployment, the obligor can still file for a reduction in them. Most Child Support obligors do not know there is free help from the state, by federal law, to obtain a modification. At the minimum, a motion should be filed to have any interest penalties set aside, which can double or triple the amount owed. Of the total media reported amount of child support owed, 83% if interest penalties and not unpaid child support. These links will teach what needs to be known about child support.

I had to file injured spouse to get my part of joint tax return. How will that affect my tax rebate in May?
Q. A company that my husband owed took our joint tax return because he had fallen behind on payments. I filed injured spouse to get my portion of the return. A. Companies cannot intercept tax refunds. State and Federal agencies can. If a private company got the refund, it's because they levied the bank account. The injured spouse form only applies to back taxes, student loans, child support and other state/federal debts. if this applies, the form will cause the rebate check to be split 50/50. However when it gets to the bank account, it can still be levied.

Do I have to file a new injured spouse for the stimulus package? Filed one with original return.?
Q. The injured spouse form filed with original return showed information for taxes and refund before this stimulus package. Now do I have to file another one and try to figure it in somehow. I understand that a portion will be used for offset which is cool but the injured spouse is not responsible for it. How does that work?

A. You do not have to file injured spouse for the stimulus payment. The IRS will use the injured spouse data from the 2007 tax return you filed and factor it in accordingly. The injured spouse's stimulus payment will not be offset if not responsible.
