incapacity benefits and income support. how do i make the transition from IB to IS?
Q. Hi, i am moving to a housing scheme and will receive support to pay living costs, however, to access the social fund i need to be on income support. since leaving work suffering more with my genetic blood disorder, i am currently in receipt of incapacity benefits. how do i make the transition from incapacity benefit to income support with as few problems as possible? regards.

A. you can't. You get the benefit you are entitled to. Do you realize that Income Support is PS40 a week less than incapacity? You also need to have been on IS for 6 months before you can access funds from the social fund.

How many people do you know on the dole or incapacity benefit who are fiddling?
Q. I think that the figure must be quite high as I personally know 7 people who are fiddling. Before anybody starts, I am not asking you to report them.

A. Let me know the names and I will report them, anyone who doesn't is just a co-conspiritor in stealing money from the sick, old, infirm, disabled, underprivelidged and disadvantaged. These people are not latter day Robin Hoods, stealing from the rich, the Government, and giving to the poor, themselves, they are just theives.

Switching from incapacity benefit to jobseekers allowance?
Q. I suffer from anxiety and panic attacks and have been off work and on incapacity benefits for about 4 years now but recently have decided to start looking for work and so have made a claim for JSA and have my interview next tuesday. My question is will they be able in anyway to assist me with my problems, is there a specific disability advisor I could speak to instead of the general ones?

Q. my brother receives this for mental health problems and is very worried that he will be made to work I'd love it if my brother could work, but at the moment it's not possible, he jumped off the top of a multi storey car park in June and broke an arm and both legs and now has epilepsy, it'll be a while before he's capable.

A. With nearly 2 million unemployed , i don't think there will be to much pressure on taking people off this benefit. But in saying that although i don't know how your brothers illness affects him, it can be good therapy to be working, rather than doing nothing.

What permitted work can be done whilst claiming incapacity.?
Q. A relative of mine has been receiving incapacity benefit for some time due to a severe back and leg condition, being unable to work has subsequently brought on depression. I have read about 'permitted work' whilst claiming this but would like to know what sort of work they could do without it affecting their benefit - I feel they need to be doing something for self esteem purposes.

A. Here are the guidelines. It doesn't actually list what would be permitted work as it will depend on the incapacity.

A. My partner gets incap and no where on the DWP website doe it state that a partner's income affects it. Incap is not a means tested benefit so as long as you are still ill and your circumstances have not changed, you will not loose incap. I looked into this before and was told as it was not means tested, my partner would not loose their incap if I went back to work. Now, IF you go onto income related ESA (the new incap) THEN yes, a partner's earnings can affect your benefit. As yet, like my partner, it sounds like you have not been sent over to ESA yet. Based on that, I can't see how your incapacity will be affected. It is a sickness benefit and non means tested as far as I was aware. The benefits that WILL be affected is any housing Benefit, [cont.]

What will happen to my incapacity benefit if I get a civil partnership?
Q. I'm on incapacity benefit with the disability element, I also get 10p income support and have my mortgage interest paid. What will happen to this if I get a civil partnership?
Asked by Canchito - Sat Apr 25 14:08:36 2009 - United Kingdom - 2 Answers - Comments
A. you will be assessed as a couple, partners circumstances will be in the calculations. Means tested benefits will be affected. Change of circumstances would need to be reported to all issuing agencies, including council benefits section, especially if you are on the 25% single person discount for Council Tax Benefit, though you should be on 100% discount for being on IS.

Who are entitled to incapacity benefits and how much are they?
Q. This is a hypothetical question and I am not asking for them nor do I need them.

A. Incapacity benefit is for those who are seen as unable to work due to medical reasons this does include mental problems like depression or stress as they are medical conditions. So it's people who are disabled, off work because off broken legs/arms. People with really bad backs ... Medical conditions that are long running, that would stop you carrying out normal work duties. How much they get depends on how long they have been sick for 1-28 weeks is PS61.35 29-52 is PS72.55 52+ is PS81.35 a week.

A. I can only offer this information which I hope is useful. The BBC are currently working on a documentary regarding the rule changes with Incapacity benefit and ESA. It may not just be the change in benefits - but the introduction of medicals or fitness for work appraisals which are carried out by ATOS healthcare on behalf of the DWP. A. Actually you are allowed *some* permitted work! Ignore the other answer. The whole idea of the new ways of dealing with sickness is that they WANT people to be able to do some work at least! THAT is the whole point for the changes! They found that people who could work and wanted but not able to go back to full time employment were stuck on benefits! Either on or off them! MANY ill or disabled people WANT to work but cannot do so without support, THIS is the reason for the changes which were being made BEFORE the *new* budget!!! How do you report someone claiming Incapacity Benefit wrongly?
Q. Theres this horrible man around the corner who is an ex fireman. Apparently he had an "accident" at work and has been retired now for a long time, claiming Incapacity Benefit. The thing is though, he helped a guy in the village build a massive house, and I often see him on the roof of his house sorting the slates out. The only time you see him "limping" and with a walking stick is when he has to go for an annual check up. How do you report someone for this claiming Incapacity Benefit when they are actually in fine health?
