Statute of limitations of CO tax debt: what is it and should I waive it?
Q. I'm trying to set up a payment plan for my 2003 CO state taxes, and in order to set the payment plan up, I have to sign a paper that says: "I agree to the terms of this agreement to pay and by doing so, I waive the statute of limitations for the collection of this debt." What does that mean? What is the statute of limitations? It doesn't sound like I should sign. Please give me info!

Doesn't sound like your going Thur with the IRS, some private collection company..don't sign, and every state has a limit on how long they can pursue a debt, (not IRS debt), the irs will work out payments for you, go on the computer and search "Statute of Limitations" and you'll get a website that shows the yearly limits of each state..becarful what you sign..

A. I believe it is 20 years on Virginia state taxes. If you never filed, they can go back as far as they want. If it is reduced to a judgement it can be renewed again and again. Federal Taxes are not the same as state tax and have a 10 year statute on assessments. There are several permutations to the law and to get an accurate answer in your case, you should consult a Virgina CPA or Enrolled Agent.

A. An online search of Florida statutes did not return and hits for 'political signs' or 'defacing signs'. The 2 hits for 'campaign signs' did not appear to have anything to do with damaging such signs. I see know reason why such signs should be singled out for special protection. They would be protected by the same laws a a billboard, or any other private property.

How long is the statute to report motor vehicle accidents in Idaho?
Q. A friend wrecked my car almost 6 months ago. At the time, my vehicle was uninsured. The driver of my vehicle was uninsured and driving on a suspended license. I was not at the accident, but became involved when I arranged with the other driver that we would handle this directly with his insurance company. Currently, the other motorist's insurance company has taken a claim that holds me responsible for being the owner of the other vehicle involved in the accident and a settlement amount has been arranged. A. You can file a police report at any time. However, a police report at this very late stage will probably do nothing. Also, as the owner of an uninsured vehicle, you may have a lot of trouble recouping anything, even in court. Who was at fault in the accident? Your explanation isn't clear. You say they are holding you responsible, does that mean they are placing you at fault? In that case, they won't fix your car, in fact, you have to pay them for the damages to their insureds vehicle. Who will you be suing? Your friend? If you are not at fault, then what is the reason they gave you for not fixing your car? If the other driver is at fault, they are required to pay you, whether or not you were uninsured.

A. You have to read the rest of the Statute. When a statute says "Except as specifically authorized by the statute, it is illegal to employ a child under 14 years of age." it means that it is illegal to employ a child under 14 unless the employment is specifically authorized by the statute. You can't apply for authorization, you need to determine, by reading the statute, whether you can be employed before turning 14. Usually 13 and younger children are only allowed to be employed by family members, but you'll have to read the rest of the Texas statute to know for certain.

What is the average relocation custody statute for a child younger than school age?
Q. My daughter is one. We are relocating because i'm getting remarried. There is no custody statute in Utah for relocation for children under the age of 5, so unless my ex and i come to an agreement, we'll have to let a judge decide. A. That depends on many factors. 1. How involved is your ex with the baby? 2. What does your current parenting plan say about moving? 3. Is the move in state or out? 4. How much money and time is your ex willing to spend? 5.Why you are moving and will it benefit the child? The judge really does not care and wont interfere to much if the move will benefit the child as long as the father still has access and visitation. However if you are moving out of state just to move your probably not going to have much luck there.

A. Fair Credit Reporting Act says that derogatory accounts will show for 7-years from the date of first delinquency. Statute of limitations varies from State to State and by what type of debt you are talking about. This is the legal time that people can sue in court and get a judgment. Once the S.O.L. has passed you can still be sued but all you have to do is show the court that the S.O.L. has expired and the case will be dismissed. I have posted a link so you can look up your State: There is no time limit on how long people can attempt to get you to pay. Never admit that a debt is yours and never pay a dime on one that is past the S.O.L. because this will restart the S.O.L.

A. I believe that the statute of limitations for property damage is now three years in California. That means that during the three years subsequent to your accident, you are responsible to repair this vehicle to it's pre-loss condition. If you fail to repair it during this time frame, your friend must file suit prior to this statute's expiration to preserve his rights to recoup his losses. What kind of "friend" are you anyways, trying to get out of fixing his car?

A. Title 26 of the U.S. Code is the codification of all federal tax laws. Section 6011 specifies the requirement of a return. The word "Confession" leads me to the conclusion that they think that a return is a violation of the fifth amendment right against self-incrimination. Tax protesters try and use the Constitution, but they haven't even read it. Here is the portion of the fifth amendment that relates to self-incrimination.
